MANILA, Philippines – The lawyers of Kris Aquino said they are still “ironing out some details” before a petition ending the actress’s 5-year marriage to basketball player James Yap can be filed in court.
In an interview on “The Buzz” aired Sunday, lawyer Anne Sharlyne Goboy-Lapuz said they are just waiting for Aquino to come home from her and her children’s 3-week vacation in the United States.
“We just prepared a petition. We’re just ironing out some details in our petition because these are based on facts that Ms. Kris has to confirm with us,” Lapuz said.
Lawyer Anna Liza Logan, Aquino’s legal counsel, also said the actress-television host has to “read the final draft of the petition and sign some documents before we can file it in court.”
Logan added that Yap’s camp has yet to contact them regarding the case. “If he wants to call to discuss anything, puwede niyang gawin ‘yon. Pero he has not done that so far.”
When asked about the custody of the couple’s 3-year-old son, Baby James, Logan said Aquino automatically gets his custody.
“The Family Code says if the child is below 7 years old, automatic, the custody will be with the mother,” she said.
Lapuz, meanwhile, reiterated Aquino’s call for privacy.
“We request the public to respect the privacy of the parties and just let the proceedings take its course,” she said.
Before the TV host quietly left for the US with sons Joshua and Baby James, she asked her lawyers to initiate the appropriate proceedings to end their marriage.
In a statement read by Boy Abunda on "The Buzz" last week, Marcos Ochoa Serapio and Tan, the law firm retained by Aquino, said it would take the "necessary steps at the soonest possible time."
"Ms. Kris Aquino has recently announced that she has decided to end her marriage to Mr. James Yap and asked us to initiate the appropriate proceedings for the purpose she believes that it is for the best interest of all that's concerned, especially her children," the law firm said.
On Friday, a source from Marcos Ochoa Serapio and Tan revealed that Aquino is firm in her decision not to reunite anymore with Yap, who earlier said he would try to save their marriage.
